By accessing or using SkillSure ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. SkillSure reserves the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

SkillSure is an AI-powered candidate assessment platform designed exclusively for evaluating job candidates during the hiring process. The Service allows companies to:

Generate AI-powered technical assessments based on job descriptions
Invite candidates to complete assessments via unique assessment codes
Evaluate candidate responses using AI-powered analysis
Review comprehensive assessment results and insights
Make data-driven hiring decisions

3. User Accounts and Eligibility

To use SkillSure, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old and represent a legitimate business entity to use the Service. You may not use the Service for any illegal or unauthorized purpose.

3.1 Team Members

SkillSure supports multiple team members per company account with role-based permissions:

Owner: Full access to all features including billing, team management, and all assessment operations
Admin: Can create, edit, publish assessments, manage team members, but cannot manage billing
Member: Can create and edit assessments but cannot publish or manage team/billing

The account owner is responsible for all activities performed by team members under their company account.

4. Subscription Plans and Billing

SkillSure offers multiple subscription tiers: Starter, Professional, and Enterprise. Each tier includes different features and usage limits as described on our Pricing page.

4.1 Free Trial

New accounts receive a 14-day free trial with full access to all features. No credit card is required to start your trial. After the trial period expires, you must subscribe to a paid plan to continue using the Service.

4.2 Subscription Terms

Subscriptions are billed monthly based on your selected plan
Starter: $19.99/month - 25 completed assessments per month, unlimited team members
Professional: $39.99/month - 60 completed assessments per month, unlimited team members
Enterprise: Custom pricing - unlimited assessments, API access, priority support
Monthly assessment limits are based on completed assessments, not created assessments
Limits reset monthly based on your subscription start date, not calendar months
Payment is processed securely through Stripe
You may cancel your subscription at any time
Refunds are provided on a case-by-case basis at our discretion
Failure to pay may result in suspension or termination of your account

5. Acceptable Use Policy

You agree not to:

Use the Service for any purpose other than legitimate candidate assessment
Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Transmit any harmful code, viruses, or malware
Attempt to gain unauthorized access to the Service or related systems
Use automated tools to scrape or extract data from the Service
Resell or redistribute the Service without explicit written permission
Use the Service to discriminate against candidates based on protected characteristics

6. Intellectual Property

SkillSure and its original content, features, and functionality are owned by SkillSure and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of all content you create within the Service, including custom questions and assessment configurations. By using the Service, you grant SkillSure a limited license to use this content solely for the purpose of providing the Service to you.

7. AI-Generated Content

SkillSure uses advanced artificial intelligence to generate assessment questions and evaluate candidate responses. While we strive for accuracy:

AI-generated content should be reviewed before use
We do not guarantee the accuracy or appropriateness of all AI-generated content
Final hiring decisions should be made by qualified human reviewers
You are responsible for ensuring compliance with anti-discrimination laws

8. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy. We implement industry-standard security measures to protect your data, but no method of transmission over the Internet is 100% secure. 9. Candidate Data and Compliance

You are responsible for complying with all applicable employment laws and regulations when using SkillSure, including but not limited to:

Equal Employment Opportunity (EEO) laws
Fair hiring practices and anti-discrimination laws
Data protection regulations (GDPR, CCPA, etc.)
Obtaining necessary consents from candidates
Providing required notices to candidates about assessment processes

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLSURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.
